USP Tucson: Deplorable Conditions in Isolation


A letter from Paul Bergrin was copied to me at his request. When I read it, I was truly angry. Now I just want to see it shoved down their throats, so not angry anymore and seeking publicity regarding the horrific conditions in SHU (the hole) at USP Tucson. This is criminal and really I want to know who is profiting from it, because someone always is.

What disturbed POS gets their rocks off subjecting prisoners to such abuse and deplorable conditions? Is this engineered by the warden at USP Tucson? The Bureau of Prisons (BOP) has really gone downhill and is at an extremely low point today.

Now that you've read Paul's statement on the conditions where he is currently being held and heard my complaint concerning the failure of the BOP to treat prisoners humanely, the worst problem is obstruction of his legal work and investigation for his current appeal. Paul Bergrin has people working on his investigation, but is now unable to confer with those assisting him. This case is extremely involved due to the range of counts that must be addressed, requiring him to be available for discussion on the telephone or email.

I have no doubt this trip to SHU that could last for 90 days is at the hands of the Newark US Attorney's Office. They have so much to lose. Paul Bergrin was busy gathering affidavits absolutely necessary to his appeal. Now he is held practically incommunicado.

As far as I am aware, the answer is no. I think that once an inmate is in BOP custody, they can do whatever they want. The inmate can file grievances and even lawsuits, but rarely is anything resolved in their favor.

The BOP is huge system. It must have a head office with responsible individuals not aware yet of what is happening in USP Tucson.They should be notified and read Paul
Bergrin's letter even if it is rarely resolved in the inmate's favor as you mention.There might be
a chance that it is read by a really
responsible individual.Why not!

I agree with you and imagine there is a responsible person that would act on this serious complaint. I wish I knew who that responsible individual is. Any names / numbers?

Think back to when Paul was in the Oklahoma City transport facility for months. To my knowledge, inmates are never supposed to be in that facility for so long, but look what they did to Paul. I haven't heard of any investigation into the missing food at that facility or anything about firing corrections officers and training others.

Not saying it's not worth a shot. Just wondering if you have any names or numbers. My experience is that they always simply deny the problems exist. This is why I say all of these people are full of crap. And I'm sure that "the hole" at USP Tucson is far from the only BOP facility where this is ongoing. Yesterday I read about one inmate filing a lawsuit against BOP for similar reasons involving other facilities. I'll have to locate a link to the article and complaint later today. Check back.

I believe this type of mistreatment is reserved for special inmates and there's a connection to the prosecuting attorneys. If communications between the Newark US Attorney's Office and USP Tucson were available, that would be the start to any investigation. I'll have to find out if any of this is discoverable using FOIA.

The reasons for the suffering under BOP's care are different, but the actions by BOP are similar. And actually, while Rakeem Baskerville was attempting to deal with his appeals he was sent on a BOP tour of solitary - going from one facility to the next for a couple of years. In other words, it could get much worse for Paul. BOP is always in cover-up mode.

Believe it or not that's what all prison's do no matter federal or state if it's one thing about the hole, shu,adseg,segregation which ever one it's another whole ball game. But I will state that when it comes to your life and family it's a must to get the appeal process going, in other words what happened to the right to defend yourself. I will tell you one thing and it's a house rule( you have no rights in any jail) and do know its even more apply because it's the always dominance PAUL BERGIN. Wish him nothing but the best and love.

Why don't his legal team go out to the prison inmates do have attorney rights or better yet take action with some judges or someone that could at least help him get his caae , appeal, investigation going on at least give the man a fair fight. But they won't because it will open the flood gate of lies and mis practice of law that took place in that court room ppl need to be held accountable.........

capable of great accomplishments.

Sorry it took so long to post that last comment - I thought I did from my phone, but apparently not.

I will agree that this requires a judge - a real one - to sort out. U.S. District Judge William Martini is one. He knew what the government game was in this case and refused to fall in lockstep with the Newark US Attorney's Office demands. His ruling were definitely unbiased and fair and the 3rd Circuit panel that ruled he be recused, well, at least one of them was contacted. No one could convince me otherwise.

The senat will soon publish a shocking report of 3600 pages concerning the tortuous techniques
used by the CIA with Al-Qaida prisoners. They should also publish a report concerning the treatments of prisoners in the BOP which is
not any better.It's always torture or violence with no respect of human

deserve it. Paul should be given his

Since 2011, our Justice system has been more aggressive in targeting whistleblowers like Bergrin instead of targeting guys like Cordova, Moran and Young.Just this simple fact proves that in the trial of Bergrin there is something that went wrong and is illegal.Someone orchestrated this trial and now
it is the responsibility of this
Justice system to find out who and why? No impidement should be
permitted to stop Bergrin's appeal.

Aren't we suppose to be the best example of democracy? Therefore, every citizen should then have the right to a fair trial. Paul Bergrin says he is not guilty and noone should be allowed to stop him from preparing his appeal adequately by locking him up in solitary confinement. Give this man the right to save his life and
prove his innocence. That would be respecting the principles of
a true democracy.

Nothing has changed really. Paul is still in SHU at USP Tucson. However, Paul will soon be moved to Terre Haute USP in Indiana. As to when this move will transpire, your guess is as good as mine, though it is supposed to be soon.

A move means going through the Oklahoma City Transfer Facility - the dive that Paul spent 15 weeks at on his way to Tucson. Inmates are only supposed to be at this place for a few days to a couple of weeks at most, so there's no halfass decent food and they are given child portions (theft of money or food?), no haircuts, no commissary, no medical care or anything else really. All of this matters less if an inmate is there for the expected time, but much more if you are Paul and the Newark US Attorney's Office is the puppetmaster.

The BOP claims there was a threat against Paul, but Paul says that's bullshit and the Newark US Attorney's Office is directing this move. Paul was doing fine in Tucson USP until he was moved to SHU and kept in isolation.

When they (BOP) puts a prisoner in
the shu they have 90 days to make
an investigation and explain what
he has done wrong.I see that Paul has been in the shu for about 90 days and now what is the result of this investigation, do you know Vicky?

My question is as to when will our Justice system stop being so rotten, when will it start being true to it's establishment. Of course, nothing is perfect but this system is only based on money and power surely not on equilibrium. If the government had any good intention in this situation, they would not allow Paul Bergrin to suffer in the shu, they would let him prepare his appeal as he should legally be allowed to do.

Mr Bergrin would definitively appreciate receiving letters from persons who support him to give him courage. Not everyone can send
him money for commissary but those
who can should send a bit so that
at least he can eat and not starve. Maybe a trust in support of the Paul Bergrin appeal could be created by his daughter Beth
Bergrin. At this time of the year
we give for generous causes why not for the appeal of a man fighting for his life. I'm all for
it, are you? Mr. Bergrin desserves
all we can do for him, he has done
a lot for many persons and now they abandon him because he is in

If only there was ONE GOOD SOUL among the LIARS that testified at
Paul Bergrin's trial. This ONE would step out in the open and say the truth. It would be the most honest thing to do.
This person would become famous for life and receive recognizion from our society. There is nothing

Yes, Paul is still in SHU. Apparently the BOP is in no hurry to transport him to Terre Haute USP. They'll make sure he spends the holidays either in SHU or in OKC Transport Facility.

Solid and true reason? The BOP claims that there are threats to harm Paul Bergrin. No clue if this is true or not, but sounds more like something engineered by Paul's trial opponents. Maybe they have Oscar and/or other lying informants spinning reality for them, creating threats. Or maybe BOP just made it up as directed. Regardless, it does get them off the hook on the 90 day rule.

Well, I do not know the specifics as I haven't see the paperwork, but I doubt I would sign any paper that waives responsibility of the institution if anything happens.

So if signing is required, I could see why Paul wouldn't no matter the validity of any threats. Remember - the government wants him dead - so waiving their responsibility is not intelligent, if that's the consent necessary to be in general population.

Beyond that, he's awaiting transfer to Terre Haute USP anyway.

Agree to last comment, not everyone should be accused of being a criminal before really solidly proven that they are. Many
people end up in prison for years and later are freed because it was
a mistake. Why would Paul Bergrins
trial not be one of these mistakes
that cost so much to all citizens.
If you are not guilty of a crime,
you should never be afraid to defend yourself. This is a free
democratical country "Live free or

Shit. There is nothing "free" about this country. Either you do not live here or you live here in a fantasy world.

Nothing that has happened to Paul Bergrin is a mistake. The trial was not a mistake. This was calculated and plotted by more than one person with power.

And innocent people plead guilty (or no contest) every flippin' minute in this country. Pleading either is not about innocence or guilt - it is all about weighing the options. Too many people do not get *that* fact.

Don't even get me started. Let's keep this about Paul Bergrin. He really had no options in this case. On the other hand, he was too busy having visits, yakking on the phone and emailing about unrelated and personal shit before and immediately before his trial. Too many people wasted his time and he didn't concentrate on his defense. His defense should have been the ONLY thing he paid attention to. But it wasn't and here we are.

Before and during Paul's trials, I refused to waste his time. I knew that every minute of his day needed to be dedicated to his defense. Too bad no one else felt the same. While Paul was busy with his personal crap his opponents were laughing, and rightfully so. And here we are. Did anyone expect anything different? I didn't. Innocence or guilt had nothing whatsoever to do with it. Paul's attention span to his defense when it counted was lackluster at best. As an attorney, he should have known that his defense would be an exercise in futility if he didn't fight with all of his strength and time every moment he was awake. He was in a fight for his life and he allowed himself to be sidetracked. Hell - he asked to be sidetracked!

Not much more for me to say.

I have had my doubts about an unnamed member of Paul's legal team on occasion. It's not Larry Lustberg or anyone from his offices.

It's a long story that I will never post, but suffice it to say that the attorney agreed to ship Rakeem Baskerville copies of much needed trial transcrips that BOP "lost" long ago. Bottom line is that the party never did what they were supposed to do. I made a quid pro quo deal and got screwed - actually Rakeem was the one that got screwed, but I was the one that made the deal on his behalf. Two attorneys involved screwed us both over. The unnamed member of Paul's team then dropped hints that I was an informant here and there so that others wouldn't respond to me on the missing transcript box problem. Can you believe that? Me? Shit. I'm the person that basically doesn't contact Paul except on rare occasions, so what could I have gained? I'm the one that wrote 98 of 100 posts on this blog.

You can tell that I'm itching to talk about it, right? ;-)

I believe there will be further legal filings on the issue of the missing trial transcripts, perhaps even a NJ Bar complaint against one of the attorneys. The other was acting as a researcher and not as an attorney though.

Rakeem Baskerville was given a BOP SHU tour - he went from one facility to another and xx inches of legal docs turned into x inches - somewhere along the way 72 inches became 40 something. By the time he knew to report the problem, they would throw something else into the mix to make that complicated. Not being an attorney, he wasn't quick to deal with it because he didn't know how to. By the time he found someone to help him the trail was cold.

Really when I made the quid pro quo deal, he was out of options. His brother was overwhelmed at the thought of pulling the specific pages/days from what was supposedly 10 boxes, copying and the trying to figure out the shipping issues. What Rakeem needed actually only amounted to one box that weighed around 20 lbs, which attorney #1 agreed to ship, but sent via UPS. The box made it to BOP's Victorville warehouse, but the COs that claimed they'd get the box from the warehouse never came through either. If the box had been shipped USPS Priority, he would have received it. Actually, attorney #1 claimed to have shipped the original box that way and sent me an invoice for Rakeem, but it was a fake invoice and no box was ever shipped. When backed into a corner, he eventually shipped it, but did so via UPS. To my knowledge, BOP institutions do not accept boxes for inmates via UPS and attorneys must send USPS - at least this is what is stated on the Victorville page of BOP's site.

The missing transcript saga went on for some time. The last time I contacted the attorney connected to Paul Bergrin and demanded they live-up to their part of the deal and ship a new box - they screwed-up by handing the box to the other attorney for shipping - they ceased contact with me and never responded again. That was close to a year ago. I even tried going through Paul to get this accomplished, and he claimed that it would be taken care of, that a new box would be shipped to Rakeem, but that never happened and then he claimed he was no longer in contact with that attorney, which was a lie. He just didn't want to deal with it OR he believed whatever BS that pal/attorney told him - no clue which. End result? Rakeem never received the docs he needs so much and everyone involved disconnected from the problem. I haven't disconnected, but am no longer speaking or am no longer able to speak to the parties involved.

Yes, it appears to be the same tortures. More, I read everywhere
that President Obama has promised to close down camps like Guantanamo. Then why using such
tortures as the shu in our US prisons,lack of food, air, human
contacts is not any better.
Imagine locked up all day in a
small room. Enough to become insane after so many days.
And above all the case of Paul Bergrin could well be an enormous
bad interpretation of the law.
Then why is he locked up to enable
him to prepare adaquetly his appeal?
This should not be our US legal system.

Find the letters that Paul wrote, they are on this website, and copy and paste them to the media. Cnn, 60 minutes, Dianne Feinsteins office...whoever you think can help. Now is the time. His letters are clear about what he learned about the govt. and why he feels he was framed.

Paul's generation was taught to be brave,to face problems and solve them. Denying Paul Bergrins appeal is only pushing the problem further and not solving it.It's always been an easy way out to take a man's life or killing him instead of finding an
intelligent equilibrium with Paul
in this situation. Killing a man is not killing the problem. Once

The reality is that in Paul Bergrins case the US has not faced the reality of solving and
finding the responsible individuals of these tortures at the Adu Ghrai prison. Instead an
organized trial was machined against Mr. Bergrin to lock him up
for life always denying the truth.
Now, they are torturing him in the
shu. What is the next step? This
is nothing more than a crime. Be

I'd like to know when is our government going to decide itself
to put some real Justice in the
Paul Bergrin trial.The excuse each
time is that a trial spends the
money of tax payers. Then why did
they not give him a chance to appeal fairly or have a retrial,
why go further and spend more money when the man can prove his
innocence. A prisoner will cost more money if in prison for life
and fights further to prove his
innocence. Why do people want to

Paul , I feel strongly that you have been really done wrong . I miss you as a dear friend. I remember when I last spoke to you coming back from Florida. I had know idea all of this was going on in your life. I would like to know how to get in touch with you. I didn't know how bad this all was for you. I didn't know that this would be my last time . Is this a real letter? Paul and I were closest cousins growing up. We were born a week apart and I have pictures of us together in a crib. Our parents were very close. Please tell me what is going on with him???

The only reason I published your obnoxious, vile lie comment is to put your stupid arse in its place. First of all, the only possibility on the dead victim would be Kemo Deshawn McCray.

So you state "He had my son murdered." Do you claim to be Kemo's mother? Do you claim to be one of Kemo's stepfathers? Which one? Johnnie Davis or Christopher Spruill?

No matter which of the 3 possible people you are claiming to be here, because the following applies to either one:

There's solid evidence that this never happened and Paul Bergrin is completely innocent. The Kemo murder count is the charge that I know the most about, so if you have some sort of question, please do ask.

Next, and this is really IMPORTANT here: You could have had a competent civil attorney file a lawsuit against a long list of government people, personally if not in their official capacity. As situations with informants go, the handling of your son by these agents and prosecutors has to be the worst in history. Your son is dead because of the many ways they all used and abused him. But then all of that started at home with mom, who was an informant, when Brokos - Manson managed to convince her that if Kemo didn't help them, the gun charge would stick.

Whichever one you claim to be, the government agents and actors managed to convince you that Paul Bergrin arranged your son's murder to save their own asses from the publicity blowup and the lawsuits. They pulled the wool over your eyes buddy. Instead of whining BS all over my blog (Yes, I am only publishing the one comment, but there's plenty more), you could be relaxing in your beach house or flying to Europe for a vacation or relocating to a different city etc... They fooled you well. I knew that when I read the Johnnie Davis testimony in the William Baskerville trial and I knew it again when I read the Davis testimony in Paul Bergrin's trials. And I knew it yet again when I read the Spruill reports, which is linked in one of the last few posts.

Yes, these government actors fooled you well. They did an excellent job pulling the wool over your eyes. There is actually NO EVIDENCE WHATSOEVER that Paul Bergrin or William Baskerville had anything at all to do with Kemo's murder on a Newark sidewalk.

Sober up and gather your thoughts, and then if you have questions, return and ask away.
